Patents

A patent is an intellectual property right granted to an inventor, the infringement of which is unlawful. Patents can provide a high level of protection and are essential for some industries such as pharmaceuticals, where years of research and development are necessary to commercialise a new product. Arfan has acted in complex patents disputes, including an alleged infringement action concerning a multi-million pound claim involving a very popular comic book super hero. His work on patents includes instructions on the use of polynucleotide arrays, the enabling technology in genetics analysis.

 

Breach of confidence/copyright

Arfan has acted for wealth management companies in breach of confidence claims involving use of confidential information, as well as for employers seeking to restrain the use of the same by way of injunction.

His copyright work includes sensitive projects of national importance to States such as copyright infringements involving top secret aircraft or weapon defence systems, as well as traditional copyright disputes. These include copyright disputes involving original artistic, musical, dramatic and literary works, including computer programs, sound recordings, films, broadcasts and typographical arrangements of published works. Ownership of copyright in a work will allow the owner to prevent unauthorised use of the work, such as the making of copies or placing the work on the internet.

 

Passing off

Arfan undertakes work in both classic and extending passing off claims. A classic passing off claim is where goodwill attaches to the claimants goods and a misreprestation is made by the Defendant to the public leading or likely to lead the public to believe that the goods or services offered by him are the goods or services of the Claimant. Damage to the Claimant then ensues by reason of the erroneous belief engendered by the Defendant’s misrepresentation that the source of the Defendant’s goods or services is the same as the source of those offered by the Claimant. The extended form of passing has developed in connection with actions in passing off brought by at least one of a class of traders sharing the collective goodwill in a mark.
