INSOLVENCY DISPUTES

Insolvency disputes may raise issues regarding the liquidation or administration of a company. This may include disputes concerning the duties of the liquidator or administrator and official receiver. A typical insolvency dispute may involve issues concerning whether certain claims constitute a provable debt in a liquidation or bankruptcy, or whether they may be treated as a liquidation expense

 

PARTNERSHIP DISPUTES

Partnership disputes may involve directors’ duties, shareholders’ disputes including share buyback disputes, takeovers, mergers and acquisitions, corporate reconstructions, loan capital and banking securities, schemes of arrangement, reductions of capital and insurance schemes.

Company disputes involve all areas of company law, including director’s duties and shareholders rights, winding up and dissolution, schemes of arrangement, and reductions of capital and other company disputes.

Many of these practice areas overlap. A property case may involve an element of fraud. A professional negligence claim may involve questions of insolvency, and a partnership dispute may involve issues of commercial fraud and jurisdictional issues. VAT/Tax disputes typically arise in claims of professional negligence against advisors, and may involve limitation issues, as well as the construction of complex tax schemes.

CHANCERY DISPUTES

Chancery disputes involve security for costs issues arising in the context of chancery and commercial litigation involving impecunious Claimants. These disputes also raise property and trust law issues. Arfan taught property law at the University of Sheffield and has appeared in numerous cases involving such disputes.

PROBATE DISPUTES

Probate disputes may raise issues concerning mental capacity of a testator, and challenges to the validity of Wills, as well as inheritance disputes. Arfan has appeared in numerous such cases.
